Clement

Our client Clement, like many, entered the United States without inspection over 17 years ago.  As time passed Clement married his wife, a United States citizen; but because of the manner of his entry, he was unable to obtain Lawful Permanent Resident Status.  In 2013 he came to see us here at Spar & Bernstein. We assisted in having his wife to file a visa petition on his behalf, which upon being approved qualified him for a Provisional Waiver.   We filed his Provisional Waiver demonstrating, among other things, that he paid his taxes, that he was a law abiding citizen, and that he and his wife were the proud parents of two beautiful US Citizen children. Once Clement’s Provisional Waiver was approved we continued his case with the National Visa Center and scheduled him for an interview back in his home country of Nigeria.   On his way to Nigeria, I bumped into Clement coincidentally in the airport in Paris while we were both making connections to different parts of the world.  Clement recognized me and I promised him he should have no problems. And 3 weeks later Clement was able to re-enter the country with no issues and his immigrant visa as a lawful permanent resident. Clement now has his green card.   We want to thank Clement for putting his faith in Spar & Bernstein and allowing us to fight on his behalf!

Granville & Janet Wallace

They say true love has no boundaries and this story is a testament to that!

Granville and Janet Wallace were married in 1974 in Jamaica, where they had two beautiful sons. In 1991 Mr. Wallace traveled to the United States, but was unfortunately unable to return home due to issues with his Visa. A devout man, Mr. Wallace’s church petitioned for him and although he waited patiently for the approval of his religious worker petition, it never came through. Truly committed to their relationship, his wife would travel back and forth to visit him in the States via a visitor’s visa and they maintained a long distance relationship. Mrs. Wallace’s brother, a United State’s citizen, petitioned for her in 2002, however in 2009 her application to renew her visitor’s visa was denied. This presented quite an obstacle, as she was now unable to visit her husband at all. It was a difficult and lonely time for the loyal couple, yet they never gave up! This brought them to our services for consultation where we renewed their hope for a long over-due reunion. Thankfully, in September of 2015 Mrs. Wallace was admitted to the United States as a Lawful Permanent Resident. We filed applications for her husband to derive status from his brother-in-law’s I-130 and through the religious worker petition; we were able to grandfather him. On September of 2016, Mr. Wallace was granted his green card and as you can see they’re happy to have chosen Spar & Bernstein!

Mr. McKinson

Here is Mr. McKinson with Shannon Laguerre and Brad Bernstein after Shannon wins his hard fought battle in deportation and removal. Mr. McKinson, who has been living in the United States out of status since 1986 was finally granted his legal status and permanent residence based on an application for cancellation of removal in Immigration Court. He commented to me that the Immigration Judge made sure to let him know that he was lucky to have had good lawyers representing him or his case may not have been granted. Mr. Mckinson's wife and family were just as thrilled. Congratulations Mr. McKinson. And welcome to legal status in America after 30 years of struggle.

Idris

Our client Idris fled his home country of Sierre Leone due to violence. He came to the United States, and he became a lawful permanent resident of the US in 1978. He worked hard. He paid taxes. He married and started a family. In 1980, his wife who he loves with all his heart was viciously attacked. In the process of coming to the rescue of his wife, the law says "he went to far" and became the "aggressor ". It was very understandable given the circumstances surrounding the defense of his wife. Yet he was prosecuted and pled guilty to an assault, a crime if he did not commit, could have ended very differently for his wife. Afterward, he lost many family members in Sierre Leone and he was never able to travel to mourn because of this one incident in the 1980s where he was defending his wife. After immigration denied his citizenship on several occasions, and threatened deportation, he came to us as a last resort. After a long fight, justice was finally served and a few days ago Idris was sworn in as United States citizen. It was a long road of more than 30 years. As Idris told me in the office "I rolled the dice and I finally won". Ganesh

Ganesh originally entered from Guyana in June 1996 and never left the United States. He worked hard to accomplish his own American dream and since his entry he established and became the owner of a successful restaurant,the Golden Apple, in Queens, New York.

Ganesh claims to have two passions: His restaurant, and his true love, his wife, who he coincidentally met while she was a customer of his at his restaurant in 2007. They fell in love quickly, lived together for several years, and officially married in 2012.

But as always, life comes with problems. Ganesh's wife was diagnosed with a heart condition which required surgery and continued doctors supervision and monitoring. He is cognizant of the need to reduce her stress and tries his best to take care of his beloved wife. He cooks her favorite meals. He makes sure the house is clean. He takes her to every doctor’s appointment and makes sure she takes her medication daily. All because he does not want her to concern herself with such small details and add undue stress. As he explained to us, "her health is the most important thing to me."

But Ganesh also had an immigration problem. He entered the United States without inspection. Even though he was married to a US citizen, Ganesh was unable to adjust his status to get a green card because of his entry problem. So Ganesh remained out of status and illegal. He was concerned to make a move for fear of getting deported. As he further explained to us: I needed "to remain in the United States to care for my wife so she can continue to live the way she deserves a happy life full of love". He simply couldn't take the chance of being separated from her.

When Ganesh came to us, his case was assigned to Shannon Martine LaGuerre one of our senior immigration attorneys. She quickly filed an I-130 visa petition for him, and than a provisional I-601 waiver for him based on hardship to his wife. The I-601 waiver allowed Ganesh to return to Guyana without penalty to obtain his green card. He went home to Guyana for approximately two weeks, had an immigration interview at the US Embassy in Georgetown, and returned a lawful permanent resident of the United States, free to run his restaurant and free to care for his wife forever. He came in recently to thank us and give us all big hugs. Pictured here is myself, Brad Bernstein with Ganesh and Shannon who did a wonderful job on his behalf.

Marco

A GOOD DAD

In the instant case Marco was residing in the United States with his father Mark. Marco has been residing with his father since the age of four. Marco’s mother has remained in Jamaica, Marco’s native country and has never visited America. And thus, Mark remained the sole provider for his son and was and is his sole parent actively involved in Marco’s support, instruction, and welfare.

But Marco had a couple of strikes against him, as far as the Immigration Service was concerned.

First, Marco entered without inspection and was not eligible to adjust his status because of his entry, even if his entry was as a baby. However, we determined that Marco was the derivative beneficiary of an I-130 Petition that was filed by his U.S. citizen grandfather, Lionel, on behalf of his now-U.S. Citizen father, on or before April 30, 2001 and was “approvable when filed.” Because the relationship between Mark and his derivative child, Marco, was in existence on or before April 30, 2001, Marco is independently grandfathered. Additionally, as a derivative beneficiary, Marco was not required to establish his physical presence in the United States on December 30, 2000. And thus accordingly, he was eligible to adjust his status under §245(i).

Second. Mark was not married to Marco’s mother. Because Marco was born out of wedlock, the immigration laws required us to prove the biological relationship and bona-fide parental relationship before approving Marco’s green card. Birth certificates are not enough in these type of cases. We demonstrated the biological relationship thru DNA evidence and the bona-fide parental relationship through school records. And now, after all that work, Marco has a green card to live in America. Recently Mark came to our office to thank us on behalf of his son Marco who now has his whole life ahead of him to make Mark proud! Pictured with me is a happy Mark (the father).

Dayanara & Dhana

When the father of Dayanara and Dhana came to our office in 2014, he was on a long waiting list for his green card. He was in legal status on a student visa, but was waiting for over 10 years for his green card based on his U.S. citizen’s parents application for him. But he was even more concerned about Dayanara and Dhana, his children still in the Philippines who were at the time aged 17 and 19, and separated from him for what seemed like an eternity. He also knew that he would have to get his children to America before they turned 21 or they would suffer the same long wait as him for a green card. Luckily his priority date became current several months after retaining us and we quickly adjusted his status to that of a lawful permanent resident in late summer 2015. But that was the easy part! Now we had to move fast to get his children their green cards who were residing in the Philippines before they “aged out”, even under the Child Status Protection Act. We had months to work before the oldest would not be eligible for her green card. We had to work through the bureaucracy to have our client’s file transferred to the National Visa Center, process Affidavits of Support, biographic data, police clearances, and have medical and visa appointments scheduled in months in Manila. And right before our clients oldest daughter “aged out”, she was able to enter the United States with her younger sister. Pictured with me is Dayanara and Dhana who recently entered the United States and are thrilled to be re-united with their father and excited to start a new life in America.

Ruben & Rosalba

CONTRIBUTING TO AMERICA

Ruben, who was born in Mexico, came to America when he was a child in the 1990’s. A “coyote” brought him across the border without inspection. When he became an adult, he married Rosalba, a U.S. citizen who honorably served in the U.S. Coast Guard. Soon after their marriage, their daughter was born and she is now serving honorably in the U.S. Navy. In fact, Rosalba comes from a long line of family who served and protected America. Rosalba’s brother is honorably serving in the U.S. Marines. So is Rosalba’s son, who is also honorably serving in the U.S. Marines. And another one of Rosalba’s daughters is serving honorably in U.S. Air force.

Ruben and Rosalba purchased a home together in NY but Ruben could not obtain a green card because he entered without inspection and lived in the United States without status for years.

Rosalba and Ruben came to us in late 2013. We filed an I-130 visa petition for him. And, upon approval of the I-130, our firm filed an I-601 state-side provisional waiver for him, based on extreme and unusual hardship to his family. The waiver was approved which allowed Ruben to return to Mexico without penalty to obtain his green card.

Ruben has since returned to the United States with his green card. Now that his immigration status has been resolved, he and his wife will open up a Mexican style restaurant in North Carolina that will be employing plenty of United States workers. So much for the theory that immigrants (even the ones who enter without inspection) do not contribute to America!

Happy Client

In 2012, our clients R-1 work visa was set to expire. And she wished to extend her work visa to continue her good work in the United States as a nun and bona-fide religious worker. With only weeks to spare, we were able to extend her religious work visa, and get her approved for her new ministry in New York. Once her R-1 visa was extended, she was free to continue her religious duties to the community. She came back to us a short time later to file for her visa petition and adjustment of status.

Today, she came into visit us as a lawful permanent resident of the United States. She thanked us and the Almighty for her easy transition to a green card.

Our client was more than proud to take a picture with us and show her gratitude. With the help of our office, and some divine intervention, she is a lawful resident. We wish her the best for the future as we are sure she will benefit lots of people she comes into contact with.
