The standard time limit for filing a personal injury claim is three years after the injury, as stated in section 214 of the New York Civil Practice Law & Rules. For medical malpractice, the statute of limitations is two and a half years to file a lawsuit. For certain claims against the City of New York and its agencies, you may have as little as 90 days to file a Notice of Claim, and one year and 90 days to file a lawsuit.

The amount of time it takes to settle a personal injury lawsuit varies based on several factors, including the nature and complexity of your case, the jurisdiction, the liability, insurance company and more.

Typically, it can take one to three years and sometimes longer, until a settlement is negotiated.
