Federal Judge Orders Release of Columbia Student Targeted for Deportation: A Victory for Free Speech and Due Process

In a decisive ruling that underscores the intersection of immigration law and constitutional rights, a federal judge has ordered the release of Columbia University student Mohsen Mahdawi, a lawful permanent resident who was detained for participating in pro-Palestinian campus protests. The Trump administration, invoking obscure legal provisions, had sought to deport Mahdawi on foreign policy grounds. The case has quickly become a flashpoint in the broader debate over immigration enforcement and First Amendment protections. 

Legal Resident Arrested During Naturalization Process 

Mohsen Mahdawi, a Palestinian-born student and longtime U.S. resident, was arrested on April 14 while attending a routine naturalization interview in Vermont. A legal green card holder, Mahdawi was in the final stages of becoming a U.S. citizen. Federal immigration agents, acting under a declaration from Secretary of State Marco Rubio, alleged that Mahdawi’s activism was contrary to U.S. foreign policy interests and sought to deport him. 

The arrest occurred amid a sweeping crackdown on foreign students engaged in pro-Palestinian advocacy. Mahdawi is one of several academics and students—including others from Georgetown and Tufts University—who have been detained under similar claims. 

The Court’s Ruling: Constitutional Protections Still Matter 

U.S. District Judge Geoffrey Crawford, an Obama appointee, ruled that Mahdawi’s continued detention violated his constitutional rights and ordered his immediate release. During the hearing, the judge drew parallels between this wave of detentions and the McCarthy-era suppression of dissent: 

“Even another day of detention is not to be tolerated,” said Crawford, likening the administration’s actions to 1950s political targeting of academics. 

Judge Crawford also emphasized that Mahdawi posed no flight risk or public safety concern. The court previously barred the administration from transferring Mahdawi to a detention facility in a more conservative jurisdiction, a tactic frequently used to limit detainees’ legal options. 

A First Amendment Battle in Immigration Court 

The core of Mahdawi’s legal challenge centers on free speech and academic freedom. His attorneys argue that the deportation effort is retaliatory and violates his right to express political views, especially criticism of foreign policy involving Israel and Palestine. 

Federal courts have shown increasing skepticism toward this strategy, with at least one Reagan-appointed judge allowing a broad First Amendment challenge to proceed. Still, the Trump administration has already signaled its intent to appeal the ruling to the 1st Circuit Court of Appeals.
